Terms of Service

1. Service Agreement
By creating an account on or otherwise using kyedns.com ("KyedNS", "the Service"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree, you must not use the Service. The Service is operated from Denmark.
KyedNS provides DNS hosting services that allow you to register and manage DNS records. The Service may be offered under free or paid subscription plans. These Terms apply regardless of which plan you use, unless a separate written agreement states otherwise.
2. Service Provided "As-Is"
The Service is provided "as-is" and "as-available" without warranties of any kind, whether express or implied, including but not limited to warranties of:
- Availability, reliability, or uptime
- Accuracy or completeness of data
- Freedom from errors, bugs, or interruptions
- Fitness for any particular purpose
- Non-infringement
3. No Service Level Agreement
No level of service availability, performance, or response time is guaranteed under these Terms. This applies to all plans, whether free or paid. A binding service level agreement (SLA) exists only if separately agreed upon in writing between you and the operator of KyedNS.
4. No Guarantee of Data Retention or Backups
We do not guarantee that your DNS records, account data, or any other information stored in the Service will be retained, backed up, or recoverable. You are solely responsible for maintaining your own copies of any data or configurations you store in the Service. We have no obligation to provide data exports or recovery in the event of data loss for any reason.
5. No Liability for Service Issues
To the maximum extent permitted by applicable law, we are not liable for any damages, losses, or issues resulting from:
- Service downtime, outages, or unavailability
- DNS propagation delays or failures
- Data loss, corruption, or inaccuracy
- Service errors, bugs, or malfunctions
- Unauthorized access to your account
- Actions taken by third-party providers or infrastructure we depend on
- Any other service-related problems
6. Limitation of Damages
To the maximum extent permitted by applicable law, our total aggregate liability for any and all claims arising out of or related to the Service shall not exceed the amount you actually paid us for the Service in the one (1) calendar month immediately preceding the event giving rise to the claim. If you are on a free plan, this means our maximum liability is zero.
In no event shall we be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to lost profits, lost data, loss of goodwill, or business interruption, regardless of the theory of liability.
7. Acceptable Use
You agree not to use the Service to:
- Host, distribute, or link to malicious content (malware, ransomware, exploits)
- Conduct phishing, fraud, or impersonation
- Send or facilitate spam or unsolicited bulk communications
- Engage in DNS abuse, including domain hijacking, cache poisoning, or DNS amplification attacks
- Violate any applicable law or regulation
- Infringe on the intellectual property rights of others
- Interfere with or disrupt the Service or its infrastructure
We may suspend or terminate accounts that violate this policy, without prior notice and without liability.
8. Account Responsibilities
You are responsible for:
- Maintaining the security of your account credentials
- All activities that occur under your account
- Ensuring your DNS configurations are correct and lawful
- Keeping your contact information current
9. Indemnification
You agree to indemnify, defend, and hold harmless the operator of KyedNS and its affiliates from and against any claims, damages, losses, liabilities, costs, and expenses (including reasonable legal fees) arising out of or related to your use of the Service, your violation of these Terms, or your violation of any rights of a third party.
10. Force Majeure
We shall not be liable for any failure or delay in performing our obligations under these Terms where such failure or delay results from circumstances beyond our reasonable control, including but not limited to: natural disasters, acts of government, power or network failures, failures of upstream DNS providers or hosting infrastructure, cyberattacks, pandemics, or other events of force majeure. During such events, our obligations are suspended for the duration of the event.
11. Service Modifications
We may modify, suspend, or discontinue any part of the Service at any time. Where practicable, we will provide reasonable notice of material changes. Continued use of the Service after changes take effect constitutes acceptance of the modified Terms.
12. Termination
We may terminate or suspend your account at any time for any reason, including but not limited to violation of these Terms or the Acceptable Use policy. You may terminate your account at any time by contacting us. Upon termination, your right to use the Service ceases immediately. We are under no obligation to retain your data after termination.
13. Dispute Resolution
Before initiating any formal legal proceedings, you agree to first contact us and attempt to resolve the dispute informally for a period of at least thirty (30) days. If the dispute cannot be resolved informally, it shall be submitted to the competent courts in Denmark.
14. Governing Law and Jurisdiction
These Terms are governed by and construed in accordance with the laws of Denmark, without regard to its conflict-of-law provisions. Any disputes not resolved under Section 13 shall be subject to the exclusive jurisdiction of the Danish courts.
